The Puppy-spot.com, LLC Acceptable Use
Policy has been designed in order to protect Puppy-Spot and customers of
Puppy-spot from illegal or improper activity on the internet. Puppy-spot
authorized users and account holders are expected to be reasonable in their
activities and abide by practices commonly accepted by the internet community
in general. The information provided here serves as the guideline for
inappropriate and appropriate behavior on the Puppy-spot network. The
information given here is, however, not comprehensive and must not be
considered to be so.
General
Puppy-spot.com comprehensively defines the
acceptable use policy, AUP, in this document while using the services of
Puppy-spot through access to the company network. By utilizing the Network, the
account holder will acknowledge that the users or you have gained access to the
Puppy-spot network through your account, have read, thoroughly understood and
agreed to abide by the AUP. The account holder will be held responsible for any
violations to the policy by any user that has been authorized by the account
holder to access this Network. AUP applies to every Network aspect, including
and not limited to paid advertisements, online chat, USENET postings, email and
websites. You will also be responsible to maintain password confidentiality
along with account information and physical security of the user’s Network
access. In the event that a violation of AUP is one by you or any user on the
account, you agree to hold, defend and indemnify Puppy-spot, its third party
developers, suppliers, employees, members and divisions against all damages,
expenses, losses, liabilities, actions, demands, claims and costs like
attorney’s fees resulting due to Network infringement, abuse or misuse. You
also agree to fully cooperate as required reasonably in Puppy-spot’s defense of
claim. Puppy-spot reserves all rights and its expenses to control and defense
of any matter subject to indemnification. You agree not to settle any issue
without a written consent from Puppy-spot. You also agree to inform Puppy-spot
immediately if there has been an unauthorized account use or breach of security
as known to you.
Rights of Puppy-spot, LLC.
If
authorized users or the account holders engage in any conduct during the use of
Network that violates AUP or is inappropriate, improper or illegal, Puppy-spot
has the right to possibly terminate or suspend the Network access without any
notification. Generally, Puppy-spot will contact you to notify you of activity
or conduct that violates AUP and will request for such activity to cease.
However, in the event where the viability of the Network is threatened or in
cases involving SPAM/UCE, alteration of IP address source information, mail
relaying, copyright infringement, harassment, illegal activities, service
attack denials, Puppy-spot has the right to terminate or suspend the account
and your access to Network without any prior notification. Also, Puppy-spot may
take further action against account holders, including legal actions, for verified
AUP violations. This may also include immediate account termination. Puppy-spot
does not promise or have an obligation to police or monitor account behavior or
activity occurring on or through the Network. It will also not have any
liability to the account holder or any party for AUP violation.
IP Addresses
Puppy-spot maintains ownership and control
of all and any IP addresses and numbers that are assigned to its Client and has
the sole discretion about the right to remove or change all or any IP addresses
or numbers.
Unauthorized or Illegal Access
Account holders or authorized users will
not try to gain illegal or unauthorized access to, or interfere or compromise
with the security and normal operations of the network, systems, application,
information and data maintained on the entity. The authorized user or account
holder will not conduct activities on the Network that may hamper the ability
of others to use or access the internet or the Network. The account holder will
also not use the Network for monitoring communications, information or data
streams on other systems or networks without proper authorization. Authorized
users and account holders will also not try to get unauthorized access to the
account files or passwords of other users or account holders.
Systems Security
Puppy-spot account holders will be
responsible to configure their systems with the basic and minimum security.
Should the systems or applications at the site of the account holder be
compromised, the sole responsibility will be of the account holder for
repairing the system or exploited application and reporting the violation. The
account holders are also prohibited from negligently or intentionally inserting
spoofed or false data on the internet, like invalid DNS information or bad
routing information.
UCE/Spamming/Mailbombing
Authorized users and account holders will
also not use the Network for transmitting large amounts of unsolicited e-mail
or intentionally send very large attachments to recipients. Unsolicited
commercial email or a series of such emails, large attachments sent to a single
recipient constitutes UCE and it is expressly prohibited. Also, mailbombing and
spamming are strongly prohibited. Using the service or the Network of another
provider for sending mailbombs, spam or UCE for promoting a website connected
to Puppy-spot or hosted on the same Network is strongly prohibited. The account
holders will also not utilize the Network for accumulating responses from UCE.
Fraud /Spoofing
Account holders will not try to transmit
any form of digital or electronic data including email while using any other
address or name other than that of the account holder. Attempts to impersonate
other corporations, companies or persons by changing source IP address or
through spoofed or forged identification information and headers is strictly
prohibited. Fraudulently concealing, spoofing or forging or falsifying the
identity of an account holder with Network use is strictly prohibited.
USENET Postings
Posting to the USENET groups should be as
per the group’s policies and charter. The account holders are strictly
prohibited from posting unrelated news groups if the post is not as per the
charter of the group. Repeated off-topic postings such as commercial messages
that are not invited by the group’s charter specifically is strictly
prohibited. Disrupting the activities or postings of the newsgroups that are
repetitious, excessive, libelous, abusive, threatening, obscene, unlawful or
frivolous is strictly prohibited.
Illegal Activity
Puppy-spot authorized users and account
holders will agree to use the Network only for lawful purposes. Using the
Network for retrieval, distribution, retransmission, transmission or storage of
digital material or information like complied programs, databases, scripts,
images which may violate applicable local, state, federal law or regulations is
strictly prohibited. This includes but will not be limited to the transmission,
retransmission and use of digital material or information with intellectual
property right, patent, trade secret, trademark and copyright that may violate
the export control laws, information that is unlawful, defamatory or obscene. In
instances involving child pornography, Puppy-spot will comply will the
applicable State and Federal laws including giving notice to the designated
agency.
Prohibited Activities
The activities given below are prohibited
expressly and may result in immediate termination of Network access:
Attempt to interfere, redirect or intercept
with any electronic communications meant for others.
Purposely transmitting and retransmitting
scripts and files that contain and activate computer virus.
Resale of Puppy-spot products or services,
unless specifically authorized in a written agreement with the company.
Providing incorrect, misleading or false
data to Puppy-spot on online or written contracts, materials, documents or
applications provided to Puppy-spot, including false credit card numbers,
fraudulent bills, paypal accounts, telephone numbers or addresses.
Attempts to modify, alter or circumvent the
programs, scripts, procedures or processes that are used by Puppy-spot to
measure bandwidth utilization, time or methods used for documenting the use of
products and services by account holders.
Any illegal, abusive or inappropriate
Network activity as specified by Puppy-spot, whether they are listed here
specifically or not, will result in immediate termination or suspension of
network access and account.
Cooperation with Civil or Criminal
Investigations
Puppy-spot fully cooperates with the
appropriate law agencies or parties that are involved in investigation of
illegal, inappropriate activities and claims conducted on the Puppy-spot
Network. Puppy-spot reserves all rights to disclose all information of account
holders as authorized by the relevant surveillance statutes.
AUP Modifications
Puppy-spot reserves all rights to modify
AUP without any prior notice at any time. When necessary or appropriate,
Puppy-spot will try to notify the account holders of the modifications either
through emails or by posting the revised AUP copy on the website.
Restrictions on Account Use
It is the responsibility of the account
holder to ensure password security. Account holders will not share user account
or password with anyone else. The account holder will also not lease or resell
any part of the Network. The account holder will also not logon to any more
than one session at once.
Mail Server Filters
Using the Puppy-spot Network for
transmitting email through any third party servers is strictly prohibited. The
account holders are also responsible to ensure that all individuals using or
accessing the Network with their authorization will comply with this AUP.
If you are aware of violations of AUP by
any corporation, company or person or authorized users accessing the Network
through your account, kindly notify Puppy-spot immediately. Puppy-spot will
notify the account holder of any complaints received in regards to alleged
violation of AUP by Network users authorized by you. You will agree to investigate
such complaints promptly and take all necessary actions to remedy actual AUP
violation. Puppy-spot may identify to complainants that the account holder,
you, are investigating the event and Puppy-spot may provide the required
information to the complainants needed to contact you directly. Each Puppy-spot
account holder should identify a representative to receive such complaint
related notices. Puppy-spot reserves all right to use and install or to have
you use and install appropriate devices on your account for preventing AUP
violations. This may include devices designed to terminate or filter Network
access provided by Puppy-spot.

LEGAL
Additional Terms and Conditions
Use of Puppy-spot Network by an authorized
user or account holder is subject to the terms and conditions listed in the
agreements entered into with Puppy-spot by account holders. The AUP document
here is incorporated by reference into these agreements.
Limitation of Liability
Puppy-spot, LLC will not be liable for any
punitive, consequential, special, incidental or indirect damages, including and
not limited to loss of use, business opportunities and business and profits
even when advised about the possibility of these damages. Puppy-spot shall also
not be liable for actual or direct damages, except to the extent that is
specified in an electronic or written agreement between the account holders and
Puppy-spot. Puppy-spot makes no representations or warranties herein, either
implied or express, concerning the Network of Puppy-spot and disclaim any
warranties of fitness for any purposes, warranties of merchantability or any
other warranties implied by the law.
All complaints about any abuse or
prohibited activity of the Puppy-spot Network, including AUP violations must be
sent through email toPuppy-spot. Kindly include all the applicable information
which may help Puppy-Spot in its investigations of the complaints including the
applicable header lines of all the forwarded messages. The sites external to
Puppy-spot Network that experience live attacks from the account holders of
Puppy-spot must inform Puppy-spot by telephone (see our contact page) and
submit a complaint at the earliest. Account holders of Puppy-spot that are not
certain whether a contemplated activity is permissible under AUP or not, kindly
